HOA Docs In Colorado

Homeowner_associationsColorado and the local Boulder/Denver market has many newer developments which have homeowner’s associations, or HOA’s.

There are a few misconceptions about what an HOA really is for a homeowner. Essentially it can be any association or organization which may implement or levy a fee or a rule for the resident homeowner.

That’s why if there is any entity that’s able to take this type of action, a buyer should be given, by virtue of the contract to buy and sell, an opportunity to review any association documents.

An article in one of our local print publications, which appears to be somewhat of a lampoon, suggests that your real estate agent has influence over the an HOA. the quote was “…and your real estate agent has soundly beaten the huge corporation running the HOA with a large stick when they demand money for unreasonable things before you’ve even purchased…”

I hope if you are considering buying you’ll see this was a tongue-in-cheek comment. While your buyer’s agent is hopefully your advocate (did you agree to sign the Buyer Agency agreement to make it official that you hired your agent to work exclusively for you?) he or she will likely explain to you that you will likely not have any influence over making any changes to By Laws, Declarations or rules and regulations dictated by the HOA.

That’s why it’s important for you as a home buyer to carefully look over the HOA docs delivered to you as a part of the ‘under contract ” process before the appropriate deadlines.
